These T&C's only relate to Trading4u selling on your behalf (Items we don't buy direct but sell for a 35% commission).
If Trading4u has provided you with a purchase price offer (i.e. Trading4u buying your item direct from you such as a Vehicle, Laptop, Bike, Bag etc) then please request to see these seperate T&C's.
Terms & Conditions of Consignment Agency by allowing your items to be collected by Trading4u Ltd you agree to be legally bound by these terms & conditions.

1. Introduction
These terms & conditions (the Terms) shall govern and be incorporated in every Contract between Trading4u (the Company) and the seller (the Seller) of an item or group of items (a good/s) on the eBay online sales platform, any other auction platform (each a Site) or any other selling channel. In these Terms, Contract means each individual arrangement for the Company to place a good or goods on the Site on behalf of the Seller, and any purchaser of a good is the Buyer. The Company may require identification evidence from every Seller (one of the following: passport, driving license, utility bill or other photo IDs), before it can act on the Seller's behalf.
2. Good/s
The Company agrees to act as a consignment agent for the Seller. The Company does not buy the good/s from the Seller. The Seller remains solely responsible for any:
- Statement the Seller states about or description of a good/s including but not limited to references as to its ownership, origin, date, age, or authenticity; and
- Faults or defects in any good/s; and
- Any other statements the Seller does or says in relation to the good/s including but not limited to any breach of these Terms.
The Seller must provide the Company with true and accurate information regarding each individual good/s.
The Seller will be charged all associated costs relating to good/s found with any fault/s that has not been highlighted to the Company or if the good/s are found to be counterfeit.
3. The Buyer
The Company does not act on behalf of the Buyer. The Company cannot guarantee the existence of, or bids made by, a Buyer or other bidders and is not responsible for anything they do or say in relation to a good/s, including but not limited to any breach of the rules of the Site (the Rules). The Seller shall be entitled to place a reasonable reserve price on any good/s. The Company charges a fee of £10 plus 3% of the actual reserve price (the Reserve Fee) for setting such a reserve price (the Company will credit the Seller for this fee should the good/s sell) and subject to any Reserve:
- The Company has absolute discretion to refuse any bid, to divide any good/s, to combine any two or more good/s or to withdraw any good/s from sale as permitted by the Rules; and
- The highest bidder reasonably acceptable to the Company shall be the Buyer; and
- Subject to the provisions of the Rules if, during the sale of a good/s, the Company considers that a dispute has arisen, or in any other circumstances in which it would be reasonable, the Company may immediately put up the good/s again for sale or, alternatively, it shall be the sole arbitrator in any dispute between bidders and its decision shall be final and binding on all concerned.
4. The Purchase Price & Commission
In return for the provision of its services and in addition to any Collection, Reserve, Relist or Other fees, the Seller authorises the Company to deduct commission of 35% (or less if so specified on the Seller's Transaction form) of the purchase price paid by the Buyer.
Where a Seller cancels instructions for the sale, the Company will charge 3% of the Reserve Fee (if applicable) and a £99 handling fee as a contribution towards its reasonable administrative costs.
The Company shall remit the remainder of the purchase price received from the Buyer to the Seller within two weeks of the Buyer receiving possession of the last good/s from the Company. A dispute with the Site, Buyer or a bank will pause this period. In addition late payment from the Buyer will also pause the one week period.
- Where any good/s fails to sell, the Company will notify the Seller accordingly. The Seller will make arrangements either:
- For the Company to re-offer the good/s for sale for a fee of £10; or
- To deliver or collect the good/s within 7 days of being so notified; or
If such arrangements are not made within 7 days of notifying the Seller that their good/s
have not sold, the Company shall sell it with proceeds minus a charge to cover its reasonable administration costs.
4b) Trading4u buying direct from Seller:
Trading4u will honor its purchase price offer on the basis the item meets its description given
by the Seller. If there is a discrepancy with the item’s condition, spec, model, make etc then
Trading4u may offer a revised purchase price offer to the Seller or will ship back the item.
Upon Trading4u receiving the Seller’s item and considering the item matches the description
given by the Seller, Trading4u will try it’s upmost to process the payment within 5 working
days but this is not guaranteed.
Trading4u will arrange the item to be collected by its own Collection Team or a contracted
courier company. The item will be covered for insurance in transit up to the sum of £50.00.
If in the unlikely event an item incurs damage in transit then Trading4u will initiate a claim
with the courier and will pass on payment to Seller once Trading4u receives payment from
the concluded claim.
Collection is free of charge for Laptops, Mobile Phones and Game Consoles. If the seller
requests the item to be returned back to them there will be a £30.00 P&P charge.
Damage in shipment is not the responsibility of Trading4u Ltd it is the responsibility of the
sender to ensure their item is suitably packaged for shipment and will not be damaged. If you
do not have the original packaging or are unsure of how to package your item, please contact
Trading4u Ltd and we will advise. Your item must be boxed in a minimum of a double
walled box. If you cannot source any packaging materials, we do offer a service to supply
them and this charge is £14.99. Any damaged, irreparable goods will either be returned to the
sender or we will pay the faulty rate of £30.00. If you, the sender, believe that the packaging
Trading4u’s Testing Team are trained to a high standard, and will test your item to an
industry standard level. Any faults or problems not specified at the time of agreeing to our
terms and conditions will affect the quote. In the event this happens, you will be contacted by
Trading4u.
Any information, data, images, drawings, photographs, and/or other materials you transmit,
submit or post (or which you transmitted, submitted or posted in the past) to Trading4u Ltd
will be considered non-confidential and non-proprietary ("Submitted Information").
Trading4u Ltd will have no obligations with respect to the Submitted Information, and by
transmitting, submitting or posting Submitted Information to Trading4uLtd you hereby grant
to Trading4u Ltd a worldwide, non-exclusive, perpetual, irrevocable, royalty-free,
sublicenseable and transferable license to disclose, distribute, display, perform, copy,
reproduce, incorporate, prepare derivative works of, and/or otherwise use the Submitted
Information for any and all commercial and non-commercial purposes, including without
limitation in connection with Trading4u Ltd.
Any physical damage such as scratches, dents, rips etc in the item are not the responsibility of
Trading4u Ltd, regardless if claimed not to be there before being sent.
All accepted quotes are agreements. Once the goods have been collected, you are agreeing to
receive payment of the agreed amount in return for your goods. You may not request for
goods to be returned after this point. In exceptional circumstance Trading4u Ltd can return
goods for a fee of £99.00.
Trading4u Ltd reserves the right to cancel an agreement at any time, for any reason, with
immediate effect. In the unlikely circumstances of this occurring, we will return the goods to
you at our own cost.
Payment will be initiated within 5 working days of Trading4u Ltd receiving the goods from
you. This does not mean you will receive payment within 5 working days, as bank transfers
can take up to 5 working days during busy periods. This timescale varies from bank to bank,
we are unable to provide an accurate ETA on your payment at any time.
Data Removal. Trading4u Ltd uses US Army AR380 process to remove data. Although this
is one of the most secure ways of removing data, Trading4u Ltd will not be held responsible
in the event of mistreatment of data or any other circumstances involving personal
information, personal data etc. We strongly advise you fully data-wipe your item (memory
bank items only such as laptops, PC’s, PDA’s etc) and back up any important files so that you
are satisfied before sending to Trading4u Ltd. Any files still on the computer cannot be
recovered. By accepting our terms and conditions you understand that you are fully
responsible for any data and for the clearing of said data on any hard drive in any machine
sold to Trading4u Ltd.
In the unlikely event of damage to Trading4u Ltd’s warehouse through fire, water damage,
storms, terrorism, robbery, theft, explosion or other catastrophic disaster, in which
stock/goods are damaged, we are obliged to pay our fully quoted amount as agreed to at time
of concluded payout from Trading4u Ltd’d insurer. This amount is payable as per our terms.
A full police/insurance report can be forwarded in the extremely unlikely event of any of
these circumstances.
Our courier insures any consignment to a maximum £50.00. If you require extra insurance on your consignment please contact Trading4u.
You must be 18 years or older in order to sell your item to Trading4u Ltd, as it binds a
contract legally when you accept the quote. You must also be the legal owner of the goods, a
5. The Seller's Obligations
The Seller confirms that:
- All information supplied regarding the Seller's identity and each good/s is true and accurate; and
- the good/s are genuine and authentic and not counterfeit. The Company reserves the right to request proof of purchase for high branded items and also reserves the right not to sell any item The Company considers to be counterfeit.
- It is the owner of the good/s, or is authorised to sell the good/s by the true owner, and that it is able to transfer full ownership (risk and reward) of the good/s to the Buyer free from any other claim; and
- In addition to these Terms it will comply with the Rules for each Site, which for the main current site eBay can be accessed on http://pages.ebay.co.uk/help/community.
6. Personal Data
The Company shall use the personal information supplied regarding the Seller to provide the services as requested by the Supplier under each Contract. The Company will not publish the Seller's personal information on the Site or pass it to any third party unless required to do so by the Rules of the Site, e.g. in the event of dispute, or by law. The Company may from time to time contact the Seller with information about the Company's services but the Seller shall be given an opportunity to opt-out of receiving such information during registration or may subsequently do so at any time.
7. General
All Contracts to which these Terms apply shall be governed by the laws of the relevant territory within the UK in which the Seller lives and the courts of that territory shall have the exclusive right to deal with any dispute.
The Seller acknowledges that the Company will commence supplying its services to the Seller when a Contract is agreed. As a result the Seller should be aware that it does not have the right to cancel a Contract under the Consumer Protection (Distance Selling) Regulations 2000 or any equivalent legislation.
The Company's rights under each Contract remain in force at all times. If the Company does not enforce any or all of these rights for any period it does not mean that it has given them up.
The Company will compensate the Seller for any loss or damage that the Seller may suffer if it fails to carry out its obligations under each Contract to a reasonable standard or breach any duties imposed on it by law (including if it causes death or personal injury by its negligence) unless that failure is attributed to: (a) the Seller's own fault; (b) a third party unconnected with the Company's provision of services under this Agreement; or (c) events which neither the Company nor its suppliers could have foreseen or forestalled even if they have taken reasonable care. Prior to an auction being concluded the company values each good/s for the purpose of possible compensation shall be the higher of its Start Price and Reserve Price.
After the conclusion of an auction it will be the higher of its Start Price and the highest bona fide bid.
